Clarification of a misunderstanding of the brothers and sisters in Maldives
I will keep it short and to the point Insha-Allah.
There are those who say “What Nasheed said is kufr, and it is clear he knows he has called to change the hudood which are from the Deen, but he may not know that it is a call to kufr, so he is excused due to ignorance”
This is incorrect as excuse of ignorance is not in regards to whether he knows it is a kufr, rather whether he knows what he mocked is from the Shariah.
Some of his statements are “we are coming out to change the strict hudood in Islam” and “They (extremists) are trying to implement the strict hudood of Islam”
From these it is clear that he has no ignorance in regards to such and such being from the Shariah, rather he mocked and called to change the Shariah itself.
If he said “we should not kill the one who marries his father’s wife” it might be interpreted that he does not know that the killing of such a person is from the Shariah. But since he directly used the word “strict hudood of Islam” it is known that he knew what he called to change is from the Deen.
Some of our brothers are misguided as to thinking “ He knew it to be from the deen, but does he know that it is an Ibaadah which’s abandonment leads to kufr? ”
First of all, that is not an excuse which is given by the shariah and the following Ayah and the Hadith regarding its Tafsir will clear it out Insha Allah.
اتَّخَذُواْ أَحْبَـرَهُمْ وَرُهْبَـنَهُمْ أَرْبَاباً مِّن دُونِ اللَّهِ وَالْمَسِيحَ ابْنَ مَرْيَمَ وَمَآ أُمِرُواْ إِلاَّ لِيَعْبُدُواْ إِلَـهاً وَحِداً لاَّ إِلَـهَ إِلاَّ هُوَ سُبْحَـنَهُ عَمَّا يُشْرِكُونَ ﴾
. They (Jews and Christians) took their rabbis and their monks to be their lords besides Allah, and (they also took as their Lord) the Messiah, son of Maryam, while they were commanded to worship none but One God, none has the right to be worshipped but He. Praise and hallowed be He above what they associate (with Him).'')
Imam Ahmad, At-Tirmidhi and Ibn Jarir At-Tabari recorded a Hadith via several chains of narration, from `Adi bin Hatim, may Allah be pleased with him, who became Christian during the time of Jahiliyyah. When the call of the Messenger of Allah reached his area, `Adi ran away to Ash-Sham, and his sister and several of his people were captured. The Messenger of Allah freed his sister and gave her gifts. So she went to her brother and encouraged him to become Muslim and to go to the Messenger of Allah . `Adi, who was one of the chiefs of his people (the tribe of Tai') and whose father, Hatim At-Ta'i, was known for his generosity, went to Al-Madinah. When the people announced his arrival, `Adi went to the Messenger of Allah wearing a silver cross around his neck. The Messenger of Allah recited this Ayah;
﴿اتَّخَذُواْ أَحْبَـرَهُمْ وَرُهْبَـنَهُمْ أَرْبَاباً مِّن دُونِ اللَّهِ﴾
(They took their rabbis and their monks to be their lords besides Allah). `Adi commented, "I said, `They did not worship them.''' The Prophet said,
«بَلَى إِنَّهُمْ حَرَّمُوا عَلَيْهِمُ الْحَلَالَ وَأَحَلُّوا لَهُمُ الْحَرَامَ فَاتَّبَعُوهُمْ فَذَلِكَ عِبَادَتُهُمْ إِيَّاهُم»
(Yes they did. They (rabbis and monks) prohibited the allowed for them (Christians and Jews) and allowed the prohibited, and they obeyed them. This is how they worshipped them.)
From this Hadith it is clear that the Jews and Christians did not know that changing the Shariah of Allah is kufr, as Adi (ra) said “They did not worship them” which indicates they did not know it to be a form of worship which’s abandonment is kufr. But Allah did not excuse them and they were called as Mushrikoon for this.
If one did not know that such and such was made Haram by Allah, and someone declared it Halal, he would be excused. But directly changing the Shariah of Allah is kufr and the ignorance regarding whether it be kufr or not, is rejected.
Sheikh Abu Butayn, a noble sheikh of Najd said in commentary of that Hadith “ Allah condemned them and called them Mushrikoon even though they did not know that that action of theirs was worship of them, so they were not excused by ignorance” al-Durar al-Saniyya (10/393-394)
